Environmental Permits

Integrated Environmental Permits
Begun the procedure for issuing integrated environmental permits.
According to legal regulations, local government units gained greater competence in the protection and improvement of the environment. According to the Law on Environment, the procedures for issuing integrated environmental permits A and B began from 01.01.2006.
The system provides integrated permits omission:

• A- integrated permits which will be issued by the Ministry of Environment and Physical Planning.
• B- integrated permits that would be issued by the units of local self-government. Installations that will be subject to these permits, must comply with the standard for issuing the limit value.

Implementation of the process for obtaining an integrated ecological (Integrated Pollution Prevention and Control – IPPC) is an obligation of operators of producing capacity in order to ensure the realization of economic development without environment degradation. Operators of existing installations (production capacity) are required to provide license for harmonization with the operational plan as a condition for continuing the work installation. Operators are obliged to submit request to the competent authority in accordance with the outlined schedule in the rate for determining the activities of installations for which the integrated environmental permit is issued respectively to harmonize the operational plan, starting from 01.01.2006 until 31.12.2009. Each industrial sector has specific time to interval for the application to the competent body.

For this purpose, the Ministry of Environment and Physical Planning has prepared REGULATION about the procedure for issuing permits for harmonization with the operational plan which defines the form, content and manner for the application to harmonize the operational plan, and documentation which shall be deposited with demand.
To obtain integrated permits is a complex process which can be successfully accomplished if licensing authorities and operator engaged in production capacity constructive mutual cooperation.

Application procedure:

• To submit a request with proposed operating plan to the Mayor of the Municipality of Gostivar.
• Form and content of the application are defined in the Regulation on the procedure for issuing permits for harmonization with the operational plan (Office Gazette no.4/06)
• The request at least is published in a newspaper in regard for public access within 7 days of receipt of request.
• All interested parties within 30 days from the date of publication are entitled to present thoughts and comments.
• Municipality may organize a public debate 25 days from the date of the publication of the application.
• Negotiations among the operator of the installation and the Mayor (can last up to one year).
• Permit decision in accordance with the operational plan.
• Within 10 days from the date of issuance of the permit in accordance with the operational plan, the Mayor announces the working permit at least in one newspaper of R.M.
• Council may organize public hearings, 25 days after the publication of the application.
• Negotiations among the operator of the installation and the Mayor (can last up to one year).
• Permit decision alignment with operational plan.
• Within 10 days from the date of issuance of the permit in accordance with the operational plan, the Mayor announces the working permit at least in one newspaper of R.M.

Elaborates on environmental protection

From 01.07.2009 to all events and activities for which is necessary preparation of elaborate for environmental protection, investor must apply for approval of the elaborate to the Municipality of Gostivar to approve the implementation of the project. Approval request for elaborate has to be submitted in three copies (hard and electronically). Elaborates should be written under the Regulation on the elaborate form and content for environmental protection (Official Gazette of R.M. nr.50/09).
All activities that require preparation of the elaborate are highlighted in the rate for activities for which necessarily elaborate must be written, and competent for the approval of this elaborate is the Mayor, the Mayor of the City of Skopje and the Mayor of the municipalities of Skopje (Gazette Official nr. 80/09 R.M.).
Elaborate has to be written according Regulation for the form and the content of environmental protection (Office Gazette of R.M. no. 50/09). 

Rate of activity necessarily elaborate must be prepared, and competent for the approval of this elaborate is the Mayor, the Mayor of the City of Skopje and the Mayor of the municipalities of Skopje.
